The intentional torts of assault, battery, false imprisonment, false arrest,
malicious prosecution, abuse of process, libel, slander, misrepresentation,
deceit, or interference with contract rights. 28 U.S.C. § 2680(h). Of these, the
assault and battery exemption is of particular importance because the
government can often successfully assert this exemption in medical claims
where the alleged malpractice can be defined as a battery or assault.
