Congress passed the Americans with Disabilities Act (ADA) in
1991. It is a complex law, with profound impacts on many areas of society, and
it is poorly drafted in several critical areas. As such, the ADA generated substantial
litigation from within a few months of its passage. It has only been in the
last 14 months that the United States Supreme Court has ruled on cases dealing
with the ADA. These rulings have clarified some aspects of the ADA, while raising
new controversies with other sections. This review attempts to explain these
Supreme Court cases within the context of the overall construction of the ADA.
Some of this discussion is based on previous articles in LMP and on Richards
and Rathbun, Medical Care Law, Aspen Publishers (1999).
