Maintaining the Records

Chapter 3 discussed the hearsay rule and medical records as business records. As such, medical records are subject to the specific legal requirements for keeping records that may be used in court: (1) the record must be made in the regular course of the business; (2) the record must be kept by a person who has personal knowledge of the act, event, or condition being recorded; (3) the record must be made at or near the time that the recorded act, event, or condition occurred or reasonably soon thereafter; and (4) the record must be kept in a consistent manner, according to a set procedure.
