TITLE:  DoD Instruction 2310.5, "Accounting for Missing Persons", 01/31/2000

SUMMARY:  This Instruction implements DoD Directive 5110.10, "Defense Prisoner of War/Missing in Action Office (DPMO)," July 16, 1993 as it pertains to boards of inquiry and case resolution files. Implements Section 1501 of Sections 1501-1513 of title 10, United States Code. Establishes policy, assigns responsibilities, and prescribes procedures followed by Military Department boards of inquiry and the officials reviewing the reports of such boards. Determines the status of covered persons and provides for the systematic, comprehensive, and timely collection, analysis, review, dissemination, and periodic update of information related to such persons. Implements Section 1502 of Sections 1501-1513 of title 10, United States Code. Establishes policy, assigns responsibilities, and prescribes procedures governing the preliminary assessment and recommendation by a commander of a person's status. Provides for the transmission of an advisory copy of the commander's preliminary assessment and recommendation to the theater Component Commander. Sets forth the procedures for safeguarding and forwarding records regarding covered persons. Implements Section 1503 of Sections 1501-1513 of title 10, United States Code by implementing policy, assigning responsibilities, and prescribing procedures to be followed by Military Department initial boards of inquiry. Implements Section 1504 of Sections 1501-1513 of title 10, United States Code by implementing policy, assigning responsibilities, and prescribing procedures to be followed by Military Department subsequent boards of inquiry. Implements Section 1505 of Sections 1501-1513 of title 10, United States Code by implementing policy, assigning responsibilities, and prescribing procedures to be followed by Military Department further review boards.  Implements Section 1506 of Sections 1501-1513 of title 10, United States Code by implementing policy, assigning responsibilities, and prescribing procedures for:  Creating and maintaining case resolution files on covered persons; and, for the protection and treatment of the contents thereof.   Implements Section 1507 of reference Sections 1501-1513 of title 10, United States Code by implementing policy, assigning responsibilities, and prescribing procedures for Military Department boards when recommending that a person be declared dead. Depending upon the nature of the board being convened. Implements Section 1509 of reference Sections 1501-1513 of title 10, United States Code by implementing policy, assigning responsibilities, and prescribing procedures for: the review of new information that may change the status of; or significantly contribute to resolving the fate of; A person who is unaccounted for from the Korean conflict, the Cold War, or the Indochina War era.   Implements policy, assigns responsibility, and prescribes procedures for the Armed Forces Identification Review Board.
