Nature of the Risk

Nature of the risk is the Supreme Court's term for the method of spreading the disease. Airborne transmission poses the greatest risk and sexual transmission the smallest risk in the workplace. When analyzing communicability, the most important question is whether the mode of transmission for the disease in question occurs in the workplace. Airborne transmission occurs in all situations, while sexual transmission is usually not a workplace risk. Foodborne illnesses are a problem for food handlers in the employee cafeteria but do not pose a threat to assembly line or sales personnel.
