1. REISSUANCE AND PURPOSE This Directive reissues
reference (a) to implement the amendment noted in
reference (b) and, thereby, establishes policy, prescribes procedures, and assigns responsibilities for the National Defense Executive Reserve (NDER).
2. APPLICABILITY This Directive applies to the Office of the Secretary of Defense (OSD), the Military Departments (including their Reserve components), and the Defense Agencies (hereafter collectively called "DoD Components"). The term "Military Services," as used herein, refers to the Army, the Navy, the Air Force, the Marine Corps, and the Coast Guard (by agreement with the Secretary of Transportation).
3. DEFINITIONS 3.1. Executive Position.
A position that is needed to direct, or to assist in the direction of, major activities in such broad functional areas as procurement, transportation, manpower, communications, supply, and research and development.
3.2. NDER Program.
A Federal program that provides a corps of highly qualified persons from industry, organized labor, professional groups, the academic community, and, to a limited extent, within Government to serve in executive positions as civilian employees during periods of national emergency.
4. POLICY It is DoD policy that, as part of the manpower mobilization base for national security, a unit or units of the NDER may be established and maintained in DoD Components.
5. PROCEDURES 5.1. The membership of individual NDER units shall be limited to the number of executive positions that cannot be filled appropriately during a national emergency by the regular employees of DoD Components.
5.2. Only persons qualified by suitable senior-level experience shall be selected as members of the NDER.
5.3. In the interest of efficiency, existing facilities, materials, and information channels shall be used as much as possible in operating the NDER program.
5.4. Persons assigned to the Ready Reserve of the Military Services may not be designated as members of the NDER. Members of the Standby Reserve and military retirees subject to recall may be included only in exceptional cases provided that it is understood that membership in the NDER will not preclude their being ordered to active duty in their military status.
5.5. NDER members are not considered officers or employees of the Federal Government during times in which they merely receive training for mobilization assignments under the NDER program. At such times, they may not act or advise on any matter pending before a DoD Component. During periods of national emergency, NDER members may be appointed as "special Government employees" as defined in 18 U.S.C. 202(a) (reference (c)). An NDER member, although subject to conflict-of-interest regulations (see FPC 24,
reference (d)), may continue to receive compensation from his or her private employer during the period he or she is performing services for the Government.
6. RESPONSIBILITIES 6.1. The
Assistant Secretary of Defense (Manpower, Reserve Affairs, and Logistics) (ASD(MRA&L)) shall:
6.1.1.
Establish the policy for and coordinate the NDER program for the Department of Defense.
6.1.2.
Comply with the information requirements prescribed in
paragraph 7.1., below.
6.1.3.
Represent the Department of Defense on the Interagency National Defense Executive Reserve Committee provided for in FPC 24
(reference (d)). 6.2. The
Deputy Assistant Secretary of Defense (Administration) (DASD(A)), for the OSD, Washington Headquarters Services (WHS), and the organizations for which the WHS provides administrative support; the
Secretaries of the Military Departments; and the
Directors of the Defense Agencies shall:
6.2.1.
Determine the need for the NDER program and establish the number of necessary NDER units.
6.2.2.
Coordinate recruitment and training of NDER members.
6.2.3.
Designate and redesignate members of the NDER in accordance with
reference (d).
6.2.4.
Determine the level of security clearance necessary for each member of the NDER under existing security standards and ensure that proper security clearance is obtained before a person is designated an NDER member.
6.2.5.
Ensure that, within funding limitations, the appropriate training is conducted for each NDER unit. This training will include general orientations and provision of up-to-date information on the actions planned in the event of mobilization and on the associated responsibilities of NDER members. NDER members shall participate in mobilization exercises to the maximum extent feasible. NDER training policies shall be based on guidance provided by the Federal Emergency Management Agency (FEMA) and the ASD(MRA&L).
6.2.6.
Ensure that all policies and regulations of FEMA and the Office of Personnel Management pertaining to the NDER program are observed (see
reference (d) and FPM Chapter 910,
reference (e)).
6.2.7.
Prescribe operating procedures consistent with this Directive and any applicable FEMA issuances that may be necessary for the efficient operation of the NDER program.
6.2.8.
Ensure that appropriate qualification levels and standards are established for the recruitment and selection of NDER members.
6.2.9.
Comply with the information requirements prescribed in
paragraph 7.2., below.
7. INFORMATION REQUIREMENTS 7.1. The ASD(MRA&L) shall provide the Director of FEMA any information required regarding DoD units established under the NDER program.
7.2. The DASD(A), for the OSD, the WHS, and the organizations for which the WHS provides administrative support; the Secretaries of the Military Departments; and the Directors of the Defense Agencies shall submit reports as required by the ASD(MRA&L) in accordance with DoD Directive 5000.19
(reference (f)). 8. EFFECTIVE DATE This Directive is effective immediately.
